Sip and Style Co Pty LtdIn these Terms of Use, “we”, “our”, “us”, or “Sip & Style Co” means Sip and Style Co Pty Ltd (ABN 22 612 741 385), and “you” means the person applying to be an Ambassador.
2.1 Acceptance of Terms
These Terms govern the Sip & Style Co Ambassador Program. You agree that when registering your interest to become an Ambassador, you have read and agreed to these Terms, the Terms of Use and our Privacy Policy. If you do not agree with these Terms, or our Privacy Policy or Terms of Use, you must immediately notify us.
2.2 Eligible applicants
You must be 18 years or older to register your interest in our Ambassador Program.
3.1 Acknowledgement
You acknowledge and agree that:
(a) the Content was created by you or you have permission from the creator to grant the right to use the Content;
(b) you have permission from all individuals featured in the Content to grant the right to use the Content;
(c) you, and anyone featured in the Content, are 18 years or over;
(d) the Content does not infringe the intellectual or other rights of third parties, including copyright, trade mark, patent, design, trade secret, moral, proprietary or other rights; and
(e) the Content is not defamatory, fraudulent, threatening, intimidating, harassing, inappropriate, harmful, hateful, abusive, tortious, obscene, invasive of another's privacy, sexist, racist, violent, degrading or otherwise unlawful.
3.2 Grant of Licence
(a) In consideration for the mutual promises and benefits granted to you under our Ambassador Program, you hereby grant to us a perpetual, non-exclusive, transferrable, sub-licensable, worldwide, royalty-free licence to use the Content in any manner determined in our discretion.
(b) We may use, display, reproduce, distribute, transmit, create derivative works, modify, alter, edit or otherwise use the Content in any manner in our discretion, with no obligation to you whatsoever.
(c) The Content may be posted, uploaded, broadcasted, live steamed or otherwise shared or used for marketing, promotional and advertising purposes, including in store, for promotional emails, in web and mobile applications, on our websites at www.sipandstyleco.com and our social media channels, including Instagram, Facebook, LinkedIn, TikTok, Twitter/X and WeChat.
3.3 Ambassador Consent
You consent (and will ensure anyone featured in the Content consents) to:
(a) us infringing any moral rights or similar rights you (or they) may have, or may acquire in the future, in the Content; and
(b) to the extent that the Content contains your personal information or sensitive information, you consent to our collection of that information and you grant us the right to use and publish your personal or sensitive information, including your social media username, profile handle, tags (including location tags), hashtags, location information and any other identifying information in connection with use of the Content in accordance with these Terms.
4.1 You acknowledge that our use of the Content does not grant any ownership rights to you in relation to our intellectual property rights, including copyright, trade mark, patent, design, trade secret, moral, proprietary or other rights.
Sip & Style Co's Privacy Policy applies to the Ambassador Program and forms part of these Terms.
You agree to indemnify and hold Sip & Style Co, its officers, directors, shareholders, employees, agents, subsidiaries and affiliates, harmless from all loss (including legal costs and expenses on a solicitor own client basis), liability (including any loss or damage to property, environmental contamination or damage, injury or death to any person) and claims made against Sip & Style Co by any third party due to, arising directly or indirectly from or in connection with your participation of the Ambassador Program, or a breach by you of any provision of these Terms, except to the extent that any loss, liability or claim is caused by the negligence or default of Sip & Style Co.
These Terms may be altered by us at any time at our discretion. We recommend you regularly review our Website to ensure you are aware of our current terms.
A term or part of these Terms that is illegal or unenforceable is severed from these Terms and the rest of these Terms continues in force.
These Terms are governed by the laws of Tasmania and each party submits to the non-exclusive jurisdiction of the courts of Hobart, Tasmania.
In this agreement:
Content means all trademarks, designs, logos, text, copy, graphics, user interfaces, visual interfaces, sounds, music, artwork and computer code contained on the Website, and includes the design, coordination, expression and “look and feel” of such content.
Intellectual Property Rights includes all present and future intellectual and industrial property rights conferred by statute, at civil, common law or equity including:
(a) copyright;
(b) design, patent, trademark, semiconductor, circuit layout, database rights or plant breeder rights (whether registered, unregistered or applied for);
(c) trade, business, company or domain name;
(d) know how, inventions or processes (whether in writing or recorded in any form); and
(e) any right to license and sub-license any of the above.
Privacy Act means the Privacy Act 1988 (Cth).
Privacy Policy means Sip & Style Co privacy policy located at Privacy Policy – Sip & Style Co (sipandstyleco.com).
Terms and Conditions means Sip & Style Co's terms located at www.sipandstyleco.com/pages/termsandconditions.

Eligibility
To be eligible for the competition, entrants must be an individual over the age of 18 years, an Australian Resident and accept these Terms and Conditions.
Employees of the Promoter and their immediate families, participating retailers and their associated agencies are not eligible to enter.

Random Prize Draw

Prize Conditions
Prizes are non-transferrable.

Prize Draw
The Prize winner will be drawn at Suite 1 Level 2, 13-17 Castray Esplanade, Hobart Tasmania 7000 at 6:00pm (AEST) on Monday the 1st of May 2023 via a random draw app, which is a random draw from people who enter the competition.
The winning entries will be determined by an employee of the Promoter (the Judge) and shall be chosen from all entries received.
The Judge’s decision is final, and no correspondence will be entered into concerning the draw outcome or procedure.
The announcement of the winners shall take place at 7:00pm (AEST) on the date of the draw at Suite 1 Level 2, 13-17 Castray Esplanade, Hobart Tasmania 7000.
The Promotor will notify the winner by direct message via Instagram through the account @sipandstyleco.
Details of the winners including the name and Instagram handle will be included on www.sipandstyleco.com from 8:00pm (AEST) on the date of the draw for a minimum period of 4 weeks.
If the winner has not redeemed the prize, or is otherwise unable to be contacted, by 6:00pm (AEST) 7 business days after the draw, the winner will forfeit the prize and the prize will be redrawn at 7:00pm (AEST) on that day at Suite 1 Level 2, 13-17 Castray Esplanade, Hobart Tasmania 7000.
The prize must be redeemed via direct message on Instagram by 7:00pm (AEST) on the date 7 Business Days after the draw date.
Promoter’s liability
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained as a result of taking the prize.
The Promoter accepts no responsibility for lost, late or misdirected entries.
All entries become the property of the Promoter. The Promoter reserves the right to display the entries on www.sipandstyleco.com and in any promotional material relating to the giveaway.

Effective: November 2023We are excited to introduce Sip Beauty Community a beauty rewards program that gives community members access to members-only discounts, exclusive samples and VIP events.
Please review the following Terms and Conditions
In these Terms and Conditions, "we", "us" or “Sip & Style Co” means Sip & Style Co (ABN 79 647 018 406) and "you" means the person, organisation or entity that signed up to the Sip & Style Co loyalty program.
These Terms and Conditions govern the relationship between you and Sip & Style Co. You agree that by signing up to Sip Beauty Community, you are bound by these Terms and Conditions.
To be eligible to join Sip Beauty Community you must:
a. be an Australian resident,
b. be aged 18 or over, and
c. provide a valid email address, phone number and physical address.
You may also provide additional information when you create your Community Membership account, such as your date of birth so that you may receive birthday Rewards. Your membership is valid from the date of joining.
a. To become a Community Member, you must register online at Sip and Style Co | Australia's Premier Beauty Destination . By applying to become a Community Member, you fully and unconditionally accept and agree to:
i. these Terms and Conditions;
ii. our Terms of Use; and
iii. receiving communications from us via email, SMS, mail and push notifications, including for the purposes outlined in our Privacy Policy.
b. If you do not agree with the conditions outlined in clause 2(a), you must not apply to become a Community Member or, if you are currently a Community Member, you must terminate your Community Membership by contacting us.
a. You are allocated to levels based on your Status Points. Once your Status Points surpasses one of the following thresholds, your Level will be increased:
Status Points
Level 0 | 0 - 299
Level 1 | 300 - 599
Level 2 | 600 - 999
Level 3 | 1000+
b. Your Spend Balance is reviewed annually from the date you joined Sip Beauty Community.
c. Status Points can take up to 48 hours to appear on your account.
a. Each $ you spend on Products converts to Beauty Points that you can exchange for products as promoted on your Sip Beauty Community Dashboard from time to time.
b. We reserve the right to withdraw, cancel or vary the distribution of Beauty Points without notice and at any time for any reason whatsoever in our absolute discretion. Beauty Points that are awarded in error or earned fraudulently may be revoked by Sip & Style Co in our absolute discretion. Beauty Points cannot be sold, transferred or assigned and are not redeemable for cash including but not limited to gift vouchers, gift cards, cheques and credit notes.
c. If a Community Membership is terminated, all remaining Beauty Points will be null and void.
a. The Sip Beauty Community operates by attributing different Rewards (as nominated by Sip & Style Co from time to time) to you according to your Level. You can view your Rewards at any time on your Sip Beauty Community Dashboard on the Website. We will endeavour to notify you via email when you are entitled to a Reward or if you move up or down to a different Level. If you unsubscribe from us, your Rewards balance will be viewable online only.
b. A Reward must be used before the expiry date stated on the Sip & Style Co website or in communications with you.
c. The period you have to use the Reward will be determined by your Level, as follows:
Level 1
up to 1 month from the date of receiving the Reward.
Level 2
up to 2 months from the date of receiving the Reward.
Level 3
up to 3 months from the date of receiving the Reward.
d. We reserve the right to withdraw, cancel or vary the distribution of Rewards without notice and at any time for any reason whatsoever in our absolute discretion. Rewards that are awarded in error or earned fraudulently may be revoked by Sip & Style Co in our absolute discretion. Rewards cannot be sold, transferred or assigned and are not redeemable for cash including but not limited to gift vouchers, gift cards, cheques and credit notes.
e. If a Community Membership is terminated, all outstanding and future Rewards will no longer be valid and will be rendered null and void.
a. You may increase your Status Points and your Beauty Points by making Qualifying Purchases. To make a Qualifying Purchase you must be logged into your Sip Beauty Community account when you make a purchase. If you use the guest checkout to make a purchase, the purchase will not count towards your Status Points or Beauty Points.
b. Cancelled orders or purchases deemed to be wholesale quantities for the purposes of resale or of a commercial nature will not count towards your Status or Beauty Points. Retail limits apply to all products per person by day. If these retail limits are exceeded, further purchases will not count towards your Status Points or Beauty Points.
c. Spend does not include decimal points and is rounded down to the nearest whole number for 49 cents and under and rounded up for 50 cents or more.
d. Shipping charges, discount vouchers, taxes, and fees are not eligible to be counted toward your Status Points or Beauty Points.
e. The purchase of gift cards will count towards your Status Points and Beauty Points, however, the redemption of gift cards will not.
f. Items on promotion will count towards your Status Points and Beauty Points at the discounted price.
a. If you decide to return a purchase and receive a refund, the refunded amount will be subtracted from your Status Points and Beauty Points. If you received a Reward for that purchase, it may be changed or taken back, which could lead to negative Status Points and Beauty Points.
b. If an order is cancelled, Sip & Style Co may adjust or reverse the Rewards, or the Status Points and Beauty Points that were previously awarded to you in that transaction.
a. If a current Community Member (Referrer) Refers a new customer (Referred Customer) and the Referred Customer joins Sip Beauty Community using the unique referral code provided by the Referrer, the Referred Customer will receive a $10 voucher to use instore or online.
b. The Referrer will also receive a $10 voucher to use in-store or online. The Referrer may Refer a maximum of 100 new customers per calendar year.
c. The Referrer and the Referred Customer may be from the same household, provided that the Referred Customer is not an existing Community Member.
d. A Referrer may not Refer themselves to be a Referred Customer by using separate email addresses. Sip & Style Co reserves the right to cancel any Sip Beauty Community accounts and revoke any Rewards awarded to a Referrer who Refers themselves.
a. We may refuse your application to become a Community Member for any reason, in our absolute discretion. Employees of Sip & Style Co are not eligible to become a Community Member.
b. If you do not provide your Personal Information to Sip & Style Co, we will be unable to give you Rewards, either in full or in part. It is your responsibility to let us know promptly if your Personal Information changes. If we do not have the correct and current information, we may not be able to reach you regarding your account, or send you offers or Rewards, and we might limit certain account functions.
a. Sip & Style Co reserves the right to suspend or terminate your Community Membership and may cancel all or any Rewards and/or benefits that have been issued to you if we reasonably believe that:
i. you have breached these Terms and Conditions;
ii. you have engaged or may engage in fraudulent conduct, or
iii. conduct is suspected to be fraudulent, in relation to your Sip Beauty Community Account.
b. Sip & Style Co reserves the right to terminate Sip Beauty Community at any time by giving all Community Members at least 30 days prior written notice.
c. You may terminate your Community Membership at any time by contacting our Customer Service Team. On receiving a notice of termination from you, your account will be recorded as closed and you will cease to earn Rewards or receive any other benefits.
d. Sip & Style Co reserves the right at all times to make any changes to these Terms and Conditions or Rewards offered at its sole discretion, including but not limited to changing the rules governing Status Levels, Status Points, Beauty Points and Rewards offered.
a. When you create a profile, Sip & Style Co collects your Personal Information. Sip & Style Co collects this personal information for the purposes of providing you with Rewards and marketing communications via email and SMS. The same information may also be used when you place an order with Sip & Style Co and for the other purposes set out in our Privacy Policy. We will manage your Personal Information in accordance with our Privacy Policy. If you do not provide your Personal Information we will be unable to offer you the Rewards set out in these Terms and Conditions or will only be able to provide you with limited Rewards.
b. By registering for Sip Beauty Community, you agree to receive emails and SMS messages regarding your Community Membership from Sip & Style Co. These may include information about your Status Level, Beauty Points, Rewards, promotions, events and programme updates, as well as other related materials at the discretion of Sip & Style Co.
c. Existing Sip & Style Co customers acknowledge and agree that on application to the Sip Beauty Community, they will be re-subscribed to receive those forms of communication from Sip & Style Co that they had previously unsubscribed or opted out of receiving (email or SMS messages).
d. You may unsubscribe from Sip Beauty Community or any other Sip & Style Co emails by clicking the ‘unsubscribe’ link in an email received by Sip & Style Co and following the prompts. If you unsubscribe from Sip & Style Co emails, you'll still receive emails about your order, shipping, gift cards and gift voucher reminders.
e. If you unsubscribe by contacting our team, it may take up to five days for your request to be processed.
a. Unless we notify you otherwise, We own or have a licence to all Intellectual Property Rights used on our Website and all of our content.

a. Sip & Style Co provides the Sip Beauty Community on an “as-is” basis. We do not guarantee that the Website or any content, service or feature offered through the site will be error-free or uninterrupted.
b. Sip & Style Co does not guarantee that any files or data you download from the Website will be free from viruses, errors or contamination.
c. You are solely responsible for your use of the Website and any linked sites. To the extent permitted by law, Sip & Style Co is not liable for any loss or damage suffered by you as a result of any failure of performance of, defect, error or omission in, interruption to, delay in operation or transmission of, computer virus transmitted through, or unauthorised access to the Website.
You agree to indemnify and hold Sip & Style Co, its officers, directors, shareholders, employees, agents, subsidiaries and affiliates, harmless from all loss, liability and claims made against Sip & Style Co by any third party due to, arising directly from your Community Membership, or a breach by you of any provision of these Terms and Conditions, except to the extent that any loss, liability or claim is caused by the negligence or default of Sip & Style Co.
a. You agree that, to the fullest extent permitted by applicable law, we will not be responsible or liable (whether in contract, tort or otherwise), under any circumstances, for any:
i. loss or misdirection of, or delay in receiving, any Community Membership application, correspondence, or information about Qualifying Purchases;
ii. theft or unauthorised redemption of Beauty Points or Rewards or use of a Reward caused by circumstances beyond the reasonable control of Sip & Style Co;
iii. any acts or omissions of third parties; or
iv. any errors published in relation to Sip Beauty Community including, without limitation, any typographical errors, errors of description, and errors in the crediting or debiting of Status Points or Beauty Points from your accounts.
b. To the extent permitted by the law, we will not be responsible for indirect, special, punitive, incidental, or consequential damages like loss of profits, revenue, data, or goodwill arising from the Website or its content, or how you use it. This applies whether it's through a contract, negligence, or other means. Our total liability will not exceed AUD$100.
Any term that is illegal or unenforceable is severed and the rest of the Terms and Conditions continue in force.
These Terms and Conditions are governed by the laws of Tasmania and each party submits to the non-exclusive jurisdiction of the courts of Tasmania.
These Terms and Conditions may be altered by us at any time at our discretion. We recommend you regularly review our Website to ensure you are aware of our current terms.
In these Terms:
Anniversary Date means the date that you joined Sip Beauty Community.
Beauty Points means a Community Member’s net cumulative Spend after any discounts and returns have been applied on Qualifying Purchases.
Customer Service Team means our dedicated customer service team that you can contact at hello@sipandstyleco.com.
Community Member means you as a member of the Sip Beauty Community.
Community Membership means your membership to Sip Beauty Community.
Dollar or $ means Australian dollars.
Intellectual Property Rights include all present and future intellectual and industrial property rights conferred by statute, at civil, common law or equity including:
(a) copyright;
(b) design, patent, trademark, semiconductor, circuit layout, database rights or plant breeder rights (whether registered, unregistered or applied for);
(c) trade, business, company or domain name;
(d) know-how, inventions or processes (whether in writing or recorded in any form); and
(e) any right to license and sub-license any of the above.
Personal Information means information, such as your name, phone number, email address, billing address and postal address.
Products means any products sold on the Sip & Style Co Website or in-store.
Qualifying Purchase means all purchases of Products and Services made on the Website while logged in to a Sip Beauty Community account or in-store, excluding any cancelled orders or purchases that are returned for a refund.
Referral means the process by which a current Community Member provides a unique referral code to a new customer to be used by the new customer when signing up to Sip Beauty Community.
Referrer has the meaning given in clause 8a.
Referred Customer has the meaning given in clause 8a.
Review Date means the Community Member’s Anniversary Date or if the Community Member has changed Status Level, the date that the Community Member most recently changed Status Level.
Rewards means the products, discounts, offers, competitions, activities, events or arrangements offered or available to Community Members from time to time.
Services means any services, including masterclasses and private events sold on the Sip & Style Co Website or in-store.
Sip Beauty Community means this Rewards programme operated by Sip & Style Co providing Community Members with access to Rewards in accordance with these Terms and Conditions.
Sip Beauty Community Dashboard means your dashboard on the Website.
Spend means money spent on Qualifying Purchases at any Sip & Style Co location or online.
Status Level means a Community Member’s level as determined according to their Status Points.
Status Points means a Community Member’s net cumulative Spend after any discounts and returns have been applied on Qualifying Purchases during the rolling 12-month period following a Community Member’s Review Date.
Terms and Conditions means these Terms and Conditions, as amended from time to time.
Website means Sip and Style Co | Australia's Premier Beauty Destination.
